UKEVENTS Weekly Update – 27 July 2023

Terrorism (Protection of Premises) draft Bill – Press release ‘Draft anti-terror bill focus on venue capacity fails to address real risk of terror attacks, Home Affairs Committee warns’ – See here for UK Parliament press release and access to Report.  LIVE has commented that ‘Overall, the Committee has found the Bill wanting on a number of fronts and set out a series of recommendations to improve matters before the actual Bill is introduced.  This includes setting a two month deadline for completion of all guidance to accompany the bill and develop concrete proposals on the potential new regulator.  At first sight, that seems a challenging deadline.

It is good to see that the Committee has recognised our concern at the lack of consideration to date for the role of licensing.

49. It is also unclear how the duties under the Bill would interact with other duties that premises may already be under to take counter-terrorism measures. For example, evidence submitted by LIVE identified licensing provisions that appeared to cover similar ground, and queried whether there was a need to impose additional duties on licensed premises, or at least why existing licensing provisions could not simply be extended.  There are also other existing laws and sets of guidance regarding health and safety of employees and other users of premises. The Government has not explained how these existing measures, and existing practices such as targeted involvement by the police, will work effectively alongside the new measures in the Bill. We are concerned that there is scope for unnecessary duplication and confusion between existing provisions and practices and the proposals in the Bill.

We will be following up with the Home Office team to better understand how they plan to incorporate the recommendations of this report (or not) and the likely timetable for the introduction of a Bill to Parliament.’
